Roulette Players lose $2.1m Lawsuit to Fallsview Casino
Over the past several years, four high stakes roulette players have been locked in a $2.1 million lawsuit with Fallsview Casino. Unfortunately for Joaquim Moreira, Moshe Braunstein, Remo Gigliotti and Tebaldo Barbuscio, a judge not only ruled in favor of Fallsview, but also ordered the men to pay the casino’s $200,000 in legal fees.
The story all began when the men were playing roulette at Fallsview Casino in 2006. They ended up losing a combined $2.1 million throughout the night – some of which was borrowed money from the casino. Everything seemed to be in order with the roulette losses; however, the four players eventually bought a lawsuit against the Niagara Falls, Canada-based gaming establishment.
Their suit hinged on a “floating ball” policy that Fallsview used. The floating ball rule allows roulette dealers to remove a “stationary” ball if the wheel is still spinning. Additionally, they could remove the ball if it takes a long time to drop into a numbered slot.
While this policy was enacted to speed up roulette games, the losing players argued that the “floating ball” was illegal and never approved by the Alcohol and Gaming Commission of Ontario. Going further, the high stakes bettors believed that Fallsview Casino was messing with the results.
However, the Ontario Court of Appeal thought differently – especially seeing as how Fallsview returned all bets that dealt with the floating ball policy. So the $2.1 million in losses came entirely through non-floating spins, meaning the lawsuit was practically baseless. Plus the bettors continued playing roulette after finding out about the floating ball rule.
After the judge ruled on this case, Moreira, Braunstein, Gigliotti and Barbuscio will have to pay back a collective $2.3 million.
